RESTRICTIONS STILL IN PLACE

India MHA issued order for the implementation of prompt and effective containment measures for COVID-19 management.

MEASURES

  • On 28 September 2021, the Ministry of Home Affairs (MHA) issued order for the implementation of prompt and effective containment measures for COVID-19 management.
  • A summary of the order is given below:
    • The measures stipulated under Annexure I shall be strictly fulfilled until 31 October 2021. The measures include
      • Ensure adherence to COVID-19 guidelines during festivities;
      • Ensure no mass gatherings in areas identified as containment zones and in districts reporting more than 5% case positivity;
      • Ensure the implementation of ‘’Test-Track-Treat-Vaccinate’’ and adherence to ‘’COVID Appropriate Behaviour’’;
      • Ensure the implementation of guidelines with respect to malls, local markets and places of worship (issued by the Ministry of Health and Family Welfare).
    • The National Directives for COVID-19 Management (Annexure II) shall be strictly fulfilled. The National Directives include the following:
      • Face coverings, social distancing, splitting in public places, work from home (WFH), staggering of work/business hours, screening & hygiene, frequent sanitization, social distancing.
    •  All the District Magistrates shall strictly enforce the relevant measures. For the enforcement of social distancing, State/UT Governments may, as far as possible, use the provisions of Section 144 of the Criminal Procedure Code (CrPC) of 1973.
    • Any person violating these measures will be liable to be proceeded against as per the provisions of Section 51 to 60 of the DM Act, besides legal action under Section 188 of the IPC, and other legal provisions as applicable.
